Since the first pioneer yelled “TIMBER” in the woods log homes have dotted the landscape. Strength, superior insulating qualities and ease of construction made these dwellings the obvious choice for the first non-native inhabitants of the forested Sierra Nevada mountains. Proof of the durability of the log home is often found by hikers who chance upon small log shacks slapped together by the 49ers of the gold rush in the 1800s but still standing today.
Don Sabin, of the now ghost town known as Seneca, built his log home in the summer of 1947 with his buddy Duke. They fell the trees on site with hand saws, notched them with axes and lifted the higher tiers in place using a home made block and tackle system. Mr. Sabin lives these rustic digs year round to this day.

I write on behalf of the CALIFORNIA ASSOCIATION OF REALTORS®, whose 170,000 members continue to witness the devastating consequences the home foreclosure crisis is having on California’s families, neighborhoods, and communities on a daily basis.
The number of families affected by foreclosure is staggering. During the past three years, more than 640,000 Californians have lost their homes. With the number of homeowners who owe more than their home is worth, hovering at 30 percent, experts predict there will be many more foreclosures in 2011 and 2012. Unless we take immediate, aggressive action to assist these homeowners, any meaningful recovery in the housing market and overall economy will continue to be delayed.
Tragically, only a fraction of those who face foreclosure will remain in their homes when all is said and done. Those whose incomes and financial circumstances meet strict guidelines may qualify for a loan modification that will reduce their monthly payment to more affordable levels. Yet the federal Home Affordable Modification Program (HAMP) is expected to prevent only 700,000 to 800,000 foreclosures nationwide before it expires at the end of 2012, and the program does little to help those homeowners who are unemployed or otherwise no longer able to meet their financial commitments. Their last hope is to sell their home, which often means convincing their lender or the investor who “owns” the loan (and, in many cases, the holder of a second mortgage lien and the mortgage insurer) to accept a “short sale.”
With a short sale, homeowners with a proven hardship negotiate an agreement to sell their home for less than the balance owed. Although not every homeowner or mortgage is eligible, those who are able to finalize a short sale avoid a foreclosure on their credit record and can move on with their lives. Last year, 20 percent of home sales in our state involved short sales.
Short sales can play an important role in our state’s economic recovery by accelerating the pace of home sales and reducing the inventory of bank-owned homes on the market. There are other benefits as well. Homebuyers who can qualify for a mortgage at today’s low interest rates also are able to purchase a home at below-market prices. Banks get a nonperforming asset off their books and avoid the headaches associated with disposing of assets they don’t want to own in the first place. Neighborhoods have fewer abandoned homes, and local businesses have more customers with money to spend.
Unfortunately, many homeowners are unable to successfully negotiate a short sale. According to a recent survey of 2,150 California REALTORS® who have assisted clients with a short sale, only three out of five transactions closed – even when there was an interested and qualified buyer.
What’s the problem? For one, no two mortgage agreements are the same, so it can be difficult to standardize short sale processes and procedures. Many homeowners have second mortgages, which further complicate matters. Then there’s the challenge of convincing multiple parties to take a financial loss or, in the case of loan servicers, to forego fees they otherwise might earn during the course of the foreclosure process. Poor and slow service by many banks and servicers has only exacerbated the problem. Horror stories abound from potential homebuyers and REALTORS® forced to wait 90 or more days for a response to a purchase offer or being required to fax short sale applications or other paperwork as many as 50 times. These delays discourage potential homebuyers from considering a short sale purchase and undermine the process for those who short sales are intended to benefit – the hundreds of thousands of families facing foreclosure.
Increasing the number of closed short sales by speeding up and streamlining the short sale process is one important way we can help California families avoid foreclosure and move our economy closer to recovery. That’s why the California Association of REALTORS® is taking steps to enable more families to arrange a short sale. Recently, we advocated for improvements to short sale guidelines established under the federal Home Affordable Foreclosure Alternative (HAFA) program. We’re meeting with major banks, U.S. Treasury officials, government-sponsored entities (including Fannie Mae and Freddie Mac), and others to urge them to standardize processes, comply with federal guidelines, improve communication with other stakeholders and increase staffing with the goal of eliminating service issues. We’ve also offered our members training in every aspect of the short sale process so they can assist their clients.
But we can’t do it alone. That’s why we’re focusing the spotlight on short sales and calling on regulators, elected officials, nonprofits, business organizations, companies, and individuals with a stake in California’s economic future to resolve this issue and others that get in the way of a recovery. It won’t be easy, and some compromises will be required. The important thing is that we need to act today. Our families and our communities can’t wait any longer.

Home Ownership Essential to Job Growth and Economy, Say Realtors®
Testifying before a Senate panel last month, National Association of REALTORS® President Ron Phipps told members of Congress that sustainable home ownership must be the goal when considering future federal housing policies.
Phipps said the housing market is starting to see signs of recovery; however, the real issue facing the nation right now is that many Americans can’t find meaningful work to support their families, and housing is essential to creating jobs.
“Home ownership is a pillar of our economy; our research suggests that home sales in this country generate more than 2.5 million private sector jobs in an average year. For every two homes sold, a job is created,” Phipps said.
He added that, while housing alone may not pull America out of this stalled economy, hampering its recovery will severely and negatively impact the nation’s recovery.
“Owning a home contributes to the strength of the nation’s economy and is still one of the best ways for individuals to build long-term wealth; therefore, we need public policies that support home ownership. Making it harder for families to afford safe mortgages does not further the goal of a housing or economic recovery,” he said. “Home buyers need a wide variety of traditionally safe, well-underwritten products with flexible down payment
requirements, said Phipps. “Overly stringent requirements will turn away 10 to 15 percent of otherwise qualified buyers who have a demonstrable ability to repay – that’s approximately 500,000 home sales that won’t happen, further delaying the housing and economic recovery.”
“We need to keep housing first on the nation’s public policy agenda to ensure that housing and national economic recoveries are sustained, and that anyone in this country who aspires to own a home and can afford to do so is not denied the opportunity to build their future through home ownership,” Phipps said.

Raising the Stakes to Reduce Whose Risk?
Some creditworthy borrowers may not be able to obtain mortgages, if Wells Fargo & Co. gets its way. The nation’ s largest mortgage lender is asking U.S. regulators to set a down payment standard of 30 percent for loans that would be exempt from a risk-retention requirement.
Banks would have to retain 5 percent of any loans with down payments of less than 30 percent if those loans are securitized.
To put this in perspective, a 20 percent down payment on a $300,000 home is $60,000. At a level of 30 percent, a borrower would need to produce $90,000.
Banks could still make loans to borrowers with less than 30 percent down, but borrowers with lower down payments would ultimately receive higher interest rates for loans that would be perceived as more risky.

Home Ownership: The Right Move According to the results of an NAR survey conducted by Harris Interactive, a substantial majority of home owners as well as renters agree that owning a home is a smart long-term decision.
In fact, 95 percent of owners and 72 percent of renters believe that over a period of several years, it makes more sense to own a home. Of those home owners surveyed, 93 percent are happy with their decision to own, and would buy again.

Does It Cost Less to Live in Rural Areas?
It costs about 16 percent less, on average, to live in rural rather than in urban areas. This implies that the official poverty rate overstates rural economic hardship compared with that in urban areas. This study uses data on food insecurity and hunger collected by the Census Bureau for USDA to estimate differences in the cost of living between rural and urban areas and is reflective of the 2000 census.

In November, the National Association of Real Estate reported that average interest rates for long-term mortgages had risen for the first time in two months according to the U.S. Federal Home Loan Mortgage Corp.
For the week ending Nov. 18, the average interest rate for 30-year fixed-rate contracts climbed off a record low of 4.17 percent to 4.39 percent with 0.9 points, while average interest rates for 15-year contracts rose from 3.57 percent to 3.76 percent with 0.7 points.
Rates for 15-year fixed-rate mortgages a year before stood at 4.32 percent. Rates for 30-year mortgages a year before averaged 4.83 percent.
Freddie Mac Vice President and Chief Economist Frank Nothaft said rates rose along with October’s retail sales report, which showed gains twice what economists had predicted. “The housing market is showing some potential gains as well,” he said, with builder confidence rising in November to the strongest level since June.
